Truck/Vechicle Hire For Carriage Of Consignment
  1. It shall be the absolute responsibility and risk of the driver, Lorry owner, of the transport operator / Vehicle owner / Broker, through whom the truck is engaged jointly and/or severally to take the consignment entrusted or goods etc, to its destination / delivery point on time and in safe condition. Once the consignment is accepted the Trucking Company/Owner/Broker of the truck or vehicle shall be fully responsible for each and every liability and responsibility of whatsoever nature in relation to the consignment and its timely delivery and hereby accepts to be held liable for any consequences arising therefrom towards the consignment owner of BriskWorld Ventures Pvt Ltd (BVPL).

  2. Shortage or non-delivery of goods or luggage or consignments of whatsoever nature, and any delay in delivery of consignment etc, for any cause or reason whatsoever will be treated as a failure and breach of terms apart from any liability for a criminal / civil breach of trust by the consignment owner/BVPL. The broker, driver and the transport owner whosoever is supplying the consignment in their vehicles will alone be held liable jointly and or severally for consequence arising out of such short delivery or non-delivery or delayed delivery. The responsibility / duty of the Driver, Lorry owner, of the transport operator / Vehicle owner, Broker, through whom the truck is engaged jointly and or severally to take the consignment of goods/material does not cease until the discharge receipt of the safe and timely delivery from the named Consignee or a BVPL office is furnished by the driver.

  3. The vehicle owner shall be liable / responsible to the company in every manner when the goods are loaded in the vehicle and such liability and responsibility will be discharged only upon furnishing of receipt of Goods Received by BVPL. In case of failure / breakdown of the vehicle on the way to the delivery destination due to whatsoever reason, it is the duty of the driver and the vehicle owner to immediately and within max thirty minutes of the breakdown to inform the Company of the same, via Phone and/or emails and/or in-person with suitable photo and video proof and also ensure to replace the vehicle to fulfil timelines of the delivery as well safety ofthe goods loaded in the vehicle at that time ensuring safe and timely delivery of the consignment.

  4. In case of failure / breakdown of the vehicle on the way to the delivery destination due to whatsoever reason, it is the duty of the driver and the vehicle owner to immediately and within max thirty minutes of the breakdown to inform the Company of the same, via Phone and/or emails and/or in-person with suitable photo or video proof and also ensure to replace the vehicle to fulfil timelines of the delivery as well safety ofthe goods loaded in the vehicle at that time ensuring safe and timely delivery of the consignment.

  5. In case of over loading by the driver i.e. over and above the allowed capacity or the consignment booked by the Consignee, the driver and owner of the vehicle shall be solely responsible / liable jointly and / or severally for any consequence arising there from.

  6. The goods booked cannot, in any case, be delivered to any third person except the consignee or his Pre authorized nominee. Any accident small or big or any delay due to whatsoever reasons most be communicated to the Company's head office by phone and or e-mail. In all such cases the entire responsibility of accident of delay or any damage to the consignment will be borne by the owner / driver of the vehicle and the transport company/Broker through whom the truck is engaged jointly and / or severally.

  7. The goods shall be carried at the risk and responsibility of the truck owner / driver / agent and they shall be the solely liable / responsible under this contact and also under “The carriage by Road Act 2007”

  8. In case of any remarks of shortage or damages made while acknowledging the receipt of the goods at the destination / delivery point, the Company shall at first instance, adjust the anticipated claim amount from the unpaid truck hire charges. Also, the truck owner / driver / agent undertakes to pay the balance claim amount if any due because of such claims arising hereinfrom.

  9. It is clearly agreed and understood that the Vehicle Owner or Driver shall not withhold any consignment for any reason whatsoever, from delivering to the Consignee, including for the reason of unpaid dues or vehicle hire charges and any such action will be treated as a criminal offence. The Company however agrees that all dues and charges for truck/vehicle hire will be paid and or adjusted within a maximum period of 30 days from issuance and delivery of physical Good received certificate or Proof of Delivery (PoD) given by the Vehicle owner.

  10. Only the courts in / at Delhi shall have jurisdiction to decide any claim, dispute, demand action or other legal proceedings arising from or in relation to the Vehicle hired or goods consigned of the Vehicle owner by the Company/BVPL.

  11. The Driver / Vehicle Owner / Transport company must have a smart phone [meaning 'a mobile phone that performs many of the functions of a computer, typically having a touchscreen interface, Internet access, and an operating system capable of running downloaded apps'] to accept the loads tendered by BVPL, perform tasks and duties w.r.t vehicle tracking, PoD raising any grievance etc.

  12. The Vehicle Provided by the vehicle owner and or driver for carriage of goods/material/consignment as entrusted herein, shall have a Pre requisite condition to be a GPRS / GSM enabled Vehicle, so as to ensure that the tracking of the vehicle en-route is always available to the Company/BVPL or the owner of the consignment. Any deviation in respect of such vehicle can only be approved in writing if and only if the driver of the vehicle is carrying a GPRS enabled phone in his possession while carrying the consignment.

  13. The Driver of the Vehicle hired under this agreement shall and is required to keep its phone always ON / connected, and in no condition shall switch OFF / disconnect its phone. And in case the same is not followed as per Company's instructions / requirements, the Company shall have an undisputed righteous levy and fix a penalty (of an amount fit and justified per the Company) and / or may exercise a right at its own choice to terminate the consignment carriage agreement and seek full refund of the advance paid if at any and the vehicle owner/driver agrees and admits such a condition hereby.

  14. BVPL is authorized by Driver / Vehicle owner / Broker and related party to Track and Trace its location during the said trip, for that purpose company should can take access of GPS, SIM tracking and/or via GLASSWING App (BVPL App).

  15. By providing the contact number to us, our service providers/ service partners/ users agree to be contacted by us or our representatives including but not limited to third parties via phone call, SMS, whatsapp,  or email.

  16. To provide drivers/ service providers/ partners/ users with the necessary assistance, to effectively communicate with the users and to maintain the application, company may provide the user information to third party to work on behalf of company.

  17. These terms and conditions will automatically apply to every Truck Owner, Driver, Transport company, Broker immediately upon acceptance of the Terms and Conditions laid above for every accepted trip and are in-force on the consignment for carriage to its designated destination and/or upon receipt of any advance money whichever is earlier.
